3. Security, privacy and legality

This agreement ("Agreement") is entered into between the user ("User") and HELIOS Media LLC, a Limited Liability Company incorporated under the laws of the State of Wyoming, United States of America ("Company" or "Operator"). Accessing, browsing and using the platform constitutes unconditional acceptance of these terms.
5. User requirements and representations
The User represents and warrants under their own criminal and civil liability:
- That they are at least 18 years old or the age of majority under the law of their country of residence.
- That access to adult material is legal in the jurisdiction where they reside.
- That they use the site exclusively for personal, private and non-commercial purposes.
- That they will not allow minors to access the site through their device or credentials.
- That they fully understand the platform is only a technical host, DOES NOT organise meetings and DOES NOT broker services.

The User undertakes not to submit, publish or transmit content that is defamatory, slanderous, damaging to reputation, graphically violent, threatening, offensive or contains hate speech.
6. Compliance with 18 U.S.C. § 2257 (US federal law)
The Company operates in full compliance with United States federal regulations, in particular the Record Keeping Requirements of 18 U.S.C. § 2257.
- All models, actors and individuals depicted in any visual content were at least 18 years old at the time of production.
- Documentation proving age is kept as required by law by the Custodian of Records, identified on the dedicated "2257 Compliance" page accessible from the site footer.
7. Subscriptions, payments and renewals
Payments are processed through secure third-party providers (e.g. SegPay, CCBill) acting as Merchant of Record. A generic description will appear on the bank statement for privacy.
Recurring subscriptions
If the User subscribes to a recurring plan, the subscription automatically renews on expiry for the same period and amount, unless cancellation is submitted through the user panel or by contacting support at least 48 hours before renewal.

All prices are in Euros and include VAT where required by law. The platform is only a technical host, and every payment received supports server sustainability and keeping content online.

8. Refund policy and waiver of the right of withdrawal (EU)
Given the digital and intangible nature of the services offered (immediate streaming):
For all users
All sales are final. Refunds are granted at the Operator's sole discretion and only for proven technical problems that cannot be resolved (e.g. an unintentional duplicate charge).
Specific to European Union users (waiver of withdrawal)
Under Article 16(m) of Directive 2011/83/EU, the User resident in the European Union expressly acknowledges and agrees that:
- Performance of the contract (access to digital content) begins immediately after payment.
- When performance begins, the User EXPRESSLY WAIVES THEIR 14-day RIGHT OF WITHDRAWAL.
- By clicking the purchase button, the User confirms awareness of the loss of the right to a refund.
9. Fraud and chargebacks (Zero Tolerance)
The User agrees to contact Customer Support before disputing any charge with their bank. Any Chargeback request deemed fraudulent ("Friendly Fraud") will result in:
- The immediate and permanent ban of the User and their IP address from this and all sites in the network.
- Reporting of the data to international anti-fraud databases shared among payment processors.
- Initiation of debt recovery proceedings for the amount owed and legal costs incurred.
The User agrees to indemnify and hold harmless the Company, its directors, employees and collaborators from any claim, damage, liability, cost or expense arising from published content, misuse, violation of laws or breach of these Terms.
10. Intellectual property and DMCA
All content is owned exclusively by or licensed to the Company. Downloading, redistributing or recording content is prohibited.

11. Limitation of liability
The service is provided "AS IS". The Company does not guarantee uninterrupted or error-free service. The Company's total liability may not exceed the amount paid by the User for the last day of service, except in cases of wilful misconduct or gross negligence within mandatory legal limits.
No agency, representation, joint venture or partnership relationship is created between the Company and the User.
- No warranty of merchantability
- No warranty of fitness for a particular purpose
- No guarantee of uninterrupted service
- No guarantee of content accuracy
12. Governing law and jurisdiction
This agreement is governed exclusively by the laws of the State of Wyoming, United States of America. The consumer's mandatory jurisdiction is preserved in all cases.
Any legal dispute falls within the exclusive jurisdiction of the state or federal courts located in Cheyenne County, Wyoming.
Any dispute will be resolved through binding individual, not collective, arbitration.
13. Dispute resolution (EU consumers)
The European Commission provides an online dispute resolution (ODR) platform accessible at: http://ec.europa.eu/consumers/odr/. However, the Company is not obliged to participate in alternative dispute resolution proceedings unless otherwise required by mandatory law.
14. Policy on preventing human trafficking and exploitation

The Platform adopts a zero tolerance principle towards:

- Coercion, threats or violence
- Involvement of minors

- Content illegal in any jurisdiction in which we operate
- Content promoting, glorifying or inciting violence
- AI-generated content (deepfakes) without explicit, documented consent
Requirements for all content
All content must:
- Depict only the person sharing it or third parties with explicit, documented consent
- Be accompanied by age verification documentation under 18 U.S.C. § 2257

The platform reserves the right to remove any non-compliant content without prior notice in the case of illegal content.
16. Malicious use

Attempts at harassment will result in permanent account suspension. This includes creating fake accounts, profiles or content with malicious intent.

Data transfers outside the EU (United States)
As HELIOS Media LLC is based in the United States, European users' personal data is transferred, processed and stored on servers in the USA. To ensure equivalent protection, the transfer is based on Standard Contractual Clauses (SCCs) approved by the European Commission, which form an integral part of this agreement.
Retention period
Data is not retained indefinitely:
- Account data: Retained until an account deletion request
- Access logs and technical data: Retained for a maximum of 12 months for security purposes, except during ongoing investigations
- Transaction and billing data: Retained for 10 years for tax and legal obligations and fraud prevention
Sharing data with third parties
We do not sell personal data to third parties for marketing. Data is shared exclusively with:
